2. Nature of Our Services
CAH acts as a facilitator and manager for motor vehicle accident claims, specifically focusing on drivers who are not at fault. Our services include, but are not limited to:
- Assisting with the documentation, assessment, and management of motor vehicle accident claims.
- Coordinating essential post-accident services, including emergency vehicle recovery (towing), panel beating and smash repairs, and the provision of replacement or hire vehicles.
- Liaising with the at-fault party's insurance company on your behalf to recover the costs associated with your accident.
Important Distinction: CAH is strictly a claims management firm. We are not an insurance provider, we do not underwrite insurance policies, and we do not act as a law firm. We do not provide financial, legal, or binding insurance advice.
3. User Obligations and Declarations
By engaging CAH, you declare and agree that:
- All information you provide regarding your identity, your vehicle, and the circumstances of your accident is entirely truthful, accurate, and complete.
- You will cooperate fully with our team, the repairers, and the replacement vehicle providers, including supplying any required documentation (such as police reports or dashcam footage) promptly.
- You have not simultaneously engaged another accident management company or legal firm to handle the same claim without our prior written consent.
Failure to provide accurate information, or providing fraudulent details, may result in the immediate termination of our services and you assuming full liability for all costs incurred.
4. Third-Party Service Providers
To deliver our comprehensive solution, CAH engages a network of independent third-party providers, including tow truck operators, smash repairers, and rental car agencies. While we carefully vet our partners:
- We do not directly employ these providers, and their services are subject to their own specific terms and conditions (which will be provided to you upon engagement of their specific service).
- CAH cannot be held directly liable for delays in parts procurement, specific repair timelines, or the actions/omissions of these independent contractors, though we will act as your advocate to resolve any issues.
5. Replacement Vehicle (Credit Hire) Disclaimer
If CAH arranges a replacement vehicle for you, it is typically provided on a "credit hire" basis. This means the cost of the rental is deferred while we attempt to recover it directly from the at-fault driver's insurer.
You acknowledge that while our service is "No Win, No Fee" under normal circumstances, you may be held personally liable for the rental costs if: (a) you provided false information about the accident; (b) you are later determined to be entirely at fault for the collision; or (c) you fail to cooperate reasonably with the claims recovery process as instructed by our team.
6. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, CAH, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website or services. This includes, but is not limited to, loss of income, loss of use of your vehicle, or emotional distress resulting from the accident or the claims process.
7. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Victoria.
